Terms of Service

These Terms of Service ("Terms") are a contract between you (an individual or the entity you represent) and Echo Prime Tech LLC("Echo," "we," "us"), operator of the Echo Forge platform at https://echosforge.comand related services (collectively, the "Services").

By creating an account, clicking accept, or using the Services, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and any product-specific limitations published at /manufacturing-limitations and /certification-limitations. If you do not agree, do not use the Services.

Echo Forge currently includes:

• Hephaestion Forge — AI-assisted software production lanes, build stages, and related tooling.
• Daedalus Forge — conversational design / CAD and manufacturability assistance (drawings, toolpaths, G-code where offered).
• Certification Forge — autonomous verification, evidence chains, and signed release verdicts (subject to fail-closed gates).
• Account, billing, health, and documentation surfaces on echosforge.com and affiliated APIs.

Features may change. Beta or preview capabilities are provided as-is and may be modified or withdrawn without liability.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for account credentials, MFA devices, and all activity under your account. Notify us promptly at [email protected] of unauthorized use.

Organization accounts must be opened by someone with authority to bind the organization. Workspace admins control member access and are responsible for tenant configuration.

Paid plans renew according to the billing period shown at checkout unless cancelled under the Refund & Cancellation Policy. Fees are stated exclusive of taxes unless noted; you are responsible for applicable taxes. We may change prices with notice before the next renewal period.

Promo codes and trials are discretionary, may be time-limited, and do not create ongoing discount rights.

Ownership of prompts, specifications, generated code, CAD, drawings, G-code, training use of customer data, cross-tenant visibility, and retention after cancellation is governed by the Intellectual Property Ownership policy, which is incorporated into these Terms.

You grant Echo a limited license to host, process, transmit, and display Customer Content solely to provide and secure the Services. You represent that you have rights to the content you submit and that it does not infringe third-party rights or violate law.

You must comply with the Acceptable Use Policy. We may suspend or terminate access for violations, security risk, non-payment, or legal compulsion.

Outputs of generative systems (code, designs, certifications, text) may be incorrect, incomplete, or unsafe for a given use. You must review, test, and validate all outputs before production, manufacturing, or safety-critical use. Echo does not warrant that outputs are free of defects, fit for a particular purpose, or non-infringing except as expressly stated in a signed enterprise agreement.

Non-public technical, commercial, and customer data exchanged under these Terms are confidential. Each party will use the other's confidential information only to perform under these Terms and will protect it with reasonable care. Exceptions: information that is public, independently developed, rightfully received from a third party, or required by law (with notice where legally permitted).

Personal data is processed under the Privacy Policy and, where applicable, the Data Processing Addendum. Subprocessors are listed at /subprocessors. Retention and deletion are described at /data-retention.

Echo and its licensors retain all rights in the Services, software, models (except customer-owned outputs as stated in the IP policy), documentation, brands, and forge names (including Hephaestion, Daedalus, and Certification Forge). No rights are granted except the limited access license to use the Services during a valid subscription.

EXCEPT AS EXPRESSLY STATED IN A SIGNED ENTERPRISE AGREEMENT, THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." ECHO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation, or that the Services will meet your requirements without review and integration work on your side.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

ECHO'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ECHO FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID).

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted.

You will defend and indemnify Echo and its officers, directors, and employees against claims, damages, and costs (including reasonable attorneys' fees) arising from your Customer Content, your use of outputs, your violation of these Terms or law, or infringement of third-party rights by materials you submit.

These Terms remain in effect while you use the Services. You may stop using the Services and cancel under the Refund & Cancellation Policy. We may suspend or terminate for material breach, non-payment, legal risk, or extended inactivity. Upon termination, your license ends; data handling follows the Data Retention & Deletion policy and the IP policy regarding post-cancellation retention.

These Terms are governed by the laws of the State of Texas, USA, excluding conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Midland County, Texas, unless a signed enterprise agreement specifies otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

We may update these Terms by posting a revised version with a new effective date. Material changes will be highlighted on this page or communicated by email where appropriate. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and cancel before the change takes effect.
